En accédant et en utilisant le logiciel, les outils, les données ou le site web de Joyfun AI (collectivement, les "Services"), vous reconnaissez expressément avoir lu et accepté d'être lié par les conditions générales suivantes (les "Conditions") ainsi que par toutes les lois et réglementations applicables. Vous reconnaissez également que vous avez 18 ans ou plus et que vous êtes légalement capable de conclure un contrat contraignant. Geographical Restrictions: The Services are strictly prohibited for use by individuals or entities located in, residing in, or accessing the Services from Mainland China and the Hong Kong Special Administrative Region (SAR). By using the Services, you represent and warrant that you are not located in or accessing the Services from these restricted regions. Definitions:

2. License to Use the Services and Usage Restrictions

We grant you a non-exclusive, non-transferable right to access and use the Services in accordance with these Terms. Joyfun AI retains all right, title, and interest in the Services. To ensure a safe and lawful environment, you strictly agree that you may not:
  • Violate Geographical Restrictions: Access, or attempt to access, the Services from Mainland China or Hong Kong SAR, including through the use of Virtual Private Networks (VPNs), proxies, or any other tools designed to bypass our geographical restrictions.
  • Generate Harmful Content: Prompt, generate, output, distribute, or use the Services to create any harmful content. This includes, but is not limited to, content that is:
    • Illegal, defamatory, obscene, or pornographic (including non-consensual sexual content and child sexual abuse material);
    • Violent, gruesome, or promoting terrorism, self-harm, or eating disorders;
    • Hateful, harassing, or discriminatory against any group or individual based on race, religion, gender, sexual orientation, or other protected characteristics;
    • Invasive of privacy rights (such as doxxing or uploading images of individuals without their consent);
    • Malicious deepfakes, disinformation, or content designed to manipulate public opinion or elections.
  • Bypass Safety Systems: Attempt to jailbreak, bypass, manipulate, or disable any safety filters, content moderation systems, or core AI instructions implemented by Joyfun AI to prevent the output of harmful content.
  • Télécharger, modifier, copier, distribuer ou créer des œuvres dérivées de notre technologie propriétaire, à l'exception du contenu que vous générez.
  • Use the Services for bullying, fraud, scamming, or in a manner that is deceptive or facilitates any harmful or illegal activities.
  • Décompiler, désosser ou désassembler les services.
  • Utiliser un robot, une araignée ou tout autre moyen automatisé pour accéder aux services à quelque fin que ce soit sans notre autorisation écrite expresse.
  • Introduce any viruses, malware, or other malicious code into our systems.
  • Use the Services to build a competitive product or service.
  • Represent that content generated by the Services is entirely human-generated. You must clearly disclose that such content was created using artificial intelligence technologies so as not to mislead others.

3. Votre contenu et votre propriété

As part of your use of the Services, you may input information (“User Input”) and the Services will generate new content based on your input (“User Output”). Your User Input and User Output are collectively referred to as “Your Content.” As between you and Joyfun AI, you own all rights in Your Content. We do not claim any ownership over it. You are free to use Your Output for any purpose, including commercial purposes, provided it complies entirely with these Terms (especially the restrictions on Harmful Content outlined in Section 2). By using the Services, you grant Joyfun AI a royalty-free, worldwide, transferable, sublicensable, and irrevocable license to access, use, host, store, reproduce, modify, and create derivative works from Your Content for the limited purposes of operating, improving, and providing the Services, and to develop new technologies. This includes using Your Content to train and improve our artificial intelligence models. This license continues even if you stop using our Services. You represent and warrant that you have all necessary rights, licenses, and permissions to submit Your Input and that Your Content will not violate any laws, contain harmful content, or infringe on the rights of any third party. Content Moderation: We reserve the right (but not the obligation) to monitor, review, block, filter, or delete any User Input or User Output that we determine, in our sole discretion, violates these Terms, attempts to bypass our safety filters, or constitutes harmful content. Due to the nature of generative AI, User Output may not be unique, and other users may generate similar content. Your ownership rights apply only to your specific User Output.

4. Durée et résiliation

These Terms take effect when you first access the Services and remain in effect until terminated. You may terminate these Terms at any time by simply discontinuing your use of the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, if you violate any provision of these Terms, particularly regarding geographical restrictions ou le generation of harmful content. Upon termination, you must cease all use of the Services and any User Output you have generated in violation of these Terms.

5. Clause de non-responsabilité et limitation de la responsabilité

THE SERVICES ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, SECURE, OR ERROR-FREE. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). You acknowledge that factual assertions in User Outputs may be inaccurate and should be independently verified. We assume no liability for any content (including harmful or offensive content) that you or any third party creates, generates, or is exposed to while using our Services.

6. Indemnisation

You agree to indemnify and hold harmless Joyfun AI, its affiliates, directors, officers, agents, and employees from and against any claims, losses, damages, liabilities, and expenses, including attorneys’ fees, arising out of your breach of these Terms, your violation of applicable law, your bypassing of safety systems, your violation of our harmful content policy, or your use of the Services or User Output.

7. Propriété intellectuelle

The Services contain intellectual property owned by Joyfun AI, including our name, logo, algorithms, designs, text, graphics, and the “look and feel.” You are prohibited from using any of our intellectual property without our prior written consent.

8. Plaintes relatives aux droits d'auteur

Si vous estimez que vos droits de propriété intellectuelle ont été violés par un utilisateur des services, veuillez envoyer une notification à l'adresse suivante support@joyfun.ai avec pour objet "Copyright Complaint". Votre avis doit comprendre : une description de l'œuvre protégée par le droit d'auteur, l'emplacement du matériel en infraction, vos coordonnées, une déclaration de bonne foi et une déclaration, sous peine de parjure, que vous êtes le titulaire du droit d'auteur ou que vous êtes autorisé à agir en son nom.

9. Résolution des litiges

Les présentes conditions sont régies par les lois de l'État de Californie, sans tenir compte des principes de conflit de lois. Tout litige découlant des présentes conditions sera résolu par un arbitrage final et contraignant, plutôt que par un tribunal.

10. Notification des modifications

Nous pouvons modifier les présentes conditions de temps à autre et nous mettrons à jour la date d'entrée en vigueur en haut de page. En continuant à utiliser les services après l'entrée en vigueur des modifications, vous serez réputé avoir accepté les conditions modifiées. Si vous n'acceptez pas les modifications, vous devez cesser d'utiliser nos services.
