Joyfun AI 服務條款

一般

透過存取和使用 Joyfun AI 的軟體、工具、資料或網站（統稱「服務」），您明確同意您已閱讀並同 意受下列條款和條件（「條款」）以及所有適用法律和法規的約束。您亦同意您已年滿 18 歲或以上，在法律上有能力簽訂具有約束力的契約。 Geographical Restrictions: The Services are strictly prohibited for use by individuals or entities located in, residing in, or accessing the Services from 中國大陸與香港特別行政區（SAR）. By using the Services, you represent and warrant that you are not located in or accessing the Services from these restricted regions. Definitions:
  • "使用者」、「您」和「您的」是指您，即使用服務的人。
  • "Joyfun AI"、"Ourselves"、"Our"、"We 「和 」Us"，是指我們的公司 Joyfun AI。

2. License to Use the Services and Usage Restrictions

We grant you a non-exclusive, non-transferable right to access and use the Services in accordance with these Terms. Joyfun AI retains all right, title, and interest in the Services. To ensure a safe and lawful environment, you strictly agree that you may not:
  • Violate Geographical Restrictions: Access, or attempt to access, the Services from Mainland China or Hong Kong SAR, including through the use of Virtual Private Networks (VPNs), proxies, or any other tools designed to bypass our geographical restrictions.
  • Generate Harmful Content: Prompt, generate, output, distribute, or use the Services to create any harmful content. This includes, but is not limited to, content that is:
    • Illegal, defamatory, obscene, or pornographic (including non-consensual sexual content and child sexual abuse material);
    • Violent, gruesome, or promoting terrorism, self-harm, or eating disorders;
    • Hateful, harassing, or discriminatory against any group or individual based on race, religion, gender, sexual orientation, or other protected characteristics;
    • Invasive of privacy rights (such as doxxing or uploading images of individuals without their consent);
    • Malicious deepfakes, disinformation, or content designed to manipulate public opinion or elections.
  • Bypass Safety Systems: Attempt to jailbreak, bypass, manipulate, or disable any safety filters, content moderation systems, or core AI instructions implemented by Joyfun AI to prevent the output of harmful content.
  • 下載、修改、複製、散佈我們的專有技術，或從中創造衍生作品，但您所產生的內容除外。
  • Use the Services for bullying, fraud, scamming, or in a manner that is deceptive or facilitates any harmful or illegal activities.
  • 對本服務進行反編譯、逆向工程或反向組譯。
  • 未經我們明確的書面許可，為任何目的使用任何機器人、蜘蛛或其他自動化方式存取服務。
  • Introduce any viruses, malware, or other malicious code into our systems.
  • Use the Services to build a competitive product or service.
  • Represent that content generated by the Services is entirely human-generated. You must clearly disclose that such content was created using artificial intelligence technologies so as not to mislead others.

3.您的內容和所有權

As part of your use of the Services, you may input information (“User Input”) and the Services will generate new content based on your input (“User Output”). Your User Input and User Output are collectively referred to as “Your Content.” As between you and Joyfun AI, you own all rights in Your Content. We do not claim any ownership over it. You are free to use Your Output for any purpose, including commercial purposes, provided it complies entirely with these Terms (especially the restrictions on Harmful Content outlined in Section 2). By using the Services, you grant Joyfun AI a royalty-free, worldwide, transferable, sublicensable, and irrevocable license to access, use, host, store, reproduce, modify, and create derivative works from Your Content for the limited purposes of operating, improving, and providing the Services, and to develop new technologies. This includes using Your Content to train and improve our artificial intelligence models. This license continues even if you stop using our Services. You represent and warrant that you have all necessary rights, licenses, and permissions to submit Your Input and that Your Content will not violate any laws, contain harmful content, or infringe on the rights of any third party. Content Moderation: We reserve the right (but not the obligation) to monitor, review, block, filter, or delete any User Input or User Output that we determine, in our sole discretion, violates these Terms, attempts to bypass our safety filters, or constitutes harmful content. Due to the nature of generative AI, User Output may not be unique, and other users may generate similar content. Your ownership rights apply only to your specific User Output.

4.期限與終止

These Terms take effect when you first access the Services and remain in effect until terminated. You may terminate these Terms at any time by simply discontinuing your use of the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, if you violate any provision of these Terms, particularly regarding geographical restrictions 或 generation of harmful content. Upon termination, you must cease all use of the Services and any User Output you have generated in violation of these Terms.

5.免責聲明及責任限制

THE SERVICES ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, SECURE, OR ERROR-FREE. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). You acknowledge that factual assertions in User Outputs may be inaccurate and should be independently verified. We assume no liability for any content (including harmful or offensive content) that you or any third party creates, generates, or is exposed to while using our Services.

6.彌償

You agree to indemnify and hold harmless Joyfun AI, its affiliates, directors, officers, agents, and employees from and against any claims, losses, damages, liabilities, and expenses, including attorneys’ fees, arising out of your breach of these Terms, your violation of applicable law, your bypassing of safety systems, your violation of our harmful content policy, or your use of the Services or User Output.

7.知識產權

The Services contain intellectual property owned by Joyfun AI, including our name, logo, algorithms, designs, text, graphics, and the “look and feel.” You are prohibited from using any of our intellectual property without our prior written consent.

8.著作權投訴

如果您認為服務使用者侵犯了您的智慧財產權，請發送通知至 support@joyfun.ai 主旨為「著作權投訴」。您的通知必須包括：著作權作品的描述、侵權材料的位置、您的聯絡資訊、善意相信的聲明，以及在偽證受罰的情況下，您是著作權所有人或受權代表他們行事的聲明。

9.爭議解決

本條款受加利福尼亞州法律管轄，不考慮其法律衝突原則。本條款所引起的任何爭議，將透過終局且具約束力的仲裁解決，而非訴諸法院。

10.變更通知

我們可能會不時修改本條款，並更新頂部的「生效日期」。您在修改生效後繼續使用服務，將被視為您接受修改後的條款。如果您不同意這些變更，您必須停止使用我們的服務。
