Joyfun AI 利用規約

一般

Joyfun AIが提供するソフトウェア、ツール、データ、ウェブサイト（以下、総称して「本サービス」といいます）にアクセスし、これを利用することにより、利用者は以下の利用規約（以下、「本規約」といいます）および適用されるすべての法令を読み、これらに拘束されることに同意したものとみなされます。また、お客様は18歳以上であり、拘束力のある契約を法的に締結できることに同意するものとします。 Geographical Restrictions: The Services are strictly prohibited for use by individuals or entities located in, residing in, or accessing the Services from 中国本土および香港特別行政区（SAR）. By using the Services, you represent and warrant that you are not located in or accessing the Services from these restricted regions. Definitions:
  • 「ユーザー」、「お客様」、および「お客様の」とは、本サービスを利用するお客様を指します。
  • 「Joyfun AI"、"Ourselves"、"Our"、"We"、"Us "は、弊社Joyfun AIを指します。
  • 「当事者」とは、利用者と当社の双方を指します。

1.プライバシーステートメント

当社は、お客様のプライバシーの保護に努めています。当社のプライバシーポリシーは、お客様が本サービスにアクセスし、本サービスを利用する際に当社に提供されるデータを当社がどのように収集し、使用するかについて説明しています。詳細については プライバシーポリシー.

2. License to Use the Services and Usage Restrictions

We grant you a non-exclusive, non-transferable right to access and use the Services in accordance with these Terms. Joyfun AI retains all right, title, and interest in the Services. To ensure a safe and lawful environment, you strictly agree that you may not:
  • Violate Geographical Restrictions: Access, or attempt to access, the Services from Mainland China or Hong Kong SAR, including through the use of Virtual Private Networks (VPNs), proxies, or any other tools designed to bypass our geographical restrictions.
  • Generate Harmful Content: Prompt, generate, output, distribute, or use the Services to create any harmful content. This includes, but is not limited to, content that is:
    • Illegal, defamatory, obscene, or pornographic (including non-consensual sexual content and child sexual abuse material);
    • Violent, gruesome, or promoting terrorism, self-harm, or eating disorders;
    • Hateful, harassing, or discriminatory against any group or individual based on race, religion, gender, sexual orientation, or other protected characteristics;
    • Invasive of privacy rights (such as doxxing or uploading images of individuals without their consent);
    • Malicious deepfakes, disinformation, or content designed to manipulate public opinion or elections.
  • Bypass Safety Systems: Attempt to jailbreak, bypass, manipulate, or disable any safety filters, content moderation systems, or core AI instructions implemented by Joyfun AI to prevent the output of harmful content.
  • お客様が作成したコンテンツを除き、当社の専有技術をダウンロード、修正、コピー、配布、または派生物を作成すること。
  • Use the Services for bullying, fraud, scamming, or in a manner that is deceptive or facilitates any harmful or illegal activities.
  • 本サービスの逆コンパイル、リバースエンジニアリング、または逆アセンブル。
  • 当社の書面による明示的な許可なく、いかなる目的であれ、ロボット、スパイダー、またはその他の自動化された手段を使用して本サービスにアクセスすること。
  • Introduce any viruses, malware, or other malicious code into our systems.
  • Use the Services to build a competitive product or service.
  • Represent that content generated by the Services is entirely human-generated. You must clearly disclose that such content was created using artificial intelligence technologies so as not to mislead others.

3.コンテンツと所有権

As part of your use of the Services, you may input information (“User Input”) and the Services will generate new content based on your input (“User Output”). Your User Input and User Output are collectively referred to as “Your Content.” As between you and Joyfun AI, you own all rights in Your Content. We do not claim any ownership over it. You are free to use Your Output for any purpose, including commercial purposes, provided it complies entirely with these Terms (especially the restrictions on Harmful Content outlined in Section 2). By using the Services, you grant Joyfun AI a royalty-free, worldwide, transferable, sublicensable, and irrevocable license to access, use, host, store, reproduce, modify, and create derivative works from Your Content for the limited purposes of operating, improving, and providing the Services, and to develop new technologies. This includes using Your Content to train and improve our artificial intelligence models. This license continues even if you stop using our Services. You represent and warrant that you have all necessary rights, licenses, and permissions to submit Your Input and that Your Content will not violate any laws, contain harmful content, or infringe on the rights of any third party. Content Moderation: We reserve the right (but not the obligation) to monitor, review, block, filter, or delete any User Input or User Output that we determine, in our sole discretion, violates these Terms, attempts to bypass our safety filters, or constitutes harmful content. Due to the nature of generative AI, User Output may not be unique, and other users may generate similar content. Your ownership rights apply only to your specific User Output.

4.契約期間と解約

These Terms take effect when you first access the Services and remain in effect until terminated. You may terminate these Terms at any time by simply discontinuing your use of the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, if you violate any provision of these Terms, particularly regarding geographical restrictions または generation of harmful content. Upon termination, you must cease all use of the Services and any User Output you have generated in violation of these Terms.

5.免責および責任の制限

THE SERVICES ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, SECURE, OR ERROR-FREE. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). You acknowledge that factual assertions in User Outputs may be inaccurate and should be independently verified. We assume no liability for any content (including harmful or offensive content) that you or any third party creates, generates, or is exposed to while using our Services.

6.補償

You agree to indemnify and hold harmless Joyfun AI, its affiliates, directors, officers, agents, and employees from and against any claims, losses, damages, liabilities, and expenses, including attorneys’ fees, arising out of your breach of these Terms, your violation of applicable law, your bypassing of safety systems, your violation of our harmful content policy, or your use of the Services or User Output.

7.知的財産

The Services contain intellectual property owned by Joyfun AI, including our name, logo, algorithms, designs, text, graphics, and the “look and feel.” You are prohibited from using any of our intellectual property without our prior written consent.

8.著作権に関する苦情

本サービスの利用者によって知的財産権が侵害されたと思われる場合は、以下の宛先にご連絡ください。 support@joyfun.ai まで、件名を「Copyright Complaint」としてお送りください。通知には、著作権で保護された作品の説明、著作権を侵害している素材の所在、あなたの連絡先情報、誠実に信じる旨の声明、および偽証罪に問われることを条件として、あなたが著作権所有者であること、または著作権所有者に代わって行動する権限を与えられていることの声明が含まれていなければなりません。

9.紛争解決

本規約は、法の抵触に関する原則にかかわらず、カリフォルニア州法に準拠するものとします。本規約に起因する紛争は、法廷ではなく、最終的かつ拘束力のある仲裁によって解決されるものとします。

10.変更の通知

当社は、本規約を随時変更することができ、上部に記載された「発効日」を更新します。変更の発効後、お客様が本サービスの利用を継続した場合、お客様は変更後の規約に同意したものとみなされます。変更に同意されない場合は、本サービスの利用を中止してください。
