Joyfun AI Användarvillkor

Allmänt

Genom att få tillgång till och använda Joyfun AI:s programvara, verktyg, data eller webbplats (gemensamt kallade "Tjänster") samtycker du uttryckligen till att du har läst och samtyckt till att vara bunden av följande villkor ("Villkoren") samt alla tillämpliga lagar och förordningar. Du samtycker också till att du är 18 år eller äldre och lagligen kan ingå ett bindande avtal. Geographical Restrictions: The Services are strictly prohibited for use by individuals or entities located in, residing in, or accessing the Services from Kina (fastlandet) och den särskilda administrativa regionen Hongkong (SAR). By using the Services, you represent and warrant that you are not located in or accessing the Services from these restricted regions. Definitions:
  • "Användare", "Du" och "Din" avser dig, den person som använder Tjänsterna.
  • "Joyfun AI", "Vi själva", "Vår", "Vi" och "Oss" avser vårt företag Joyfun AI.
  • Med "Part" eller "Parter" avses både Användaren och vi själva.

1. Integritetspolicy

2. License to Use the Services and Usage Restrictions

We grant you a non-exclusive, non-transferable right to access and use the Services in accordance with these Terms. Joyfun AI retains all right, title, and interest in the Services. To ensure a safe and lawful environment, you strictly agree that you may not:
  • Violate Geographical Restrictions: Access, or attempt to access, the Services from Mainland China or Hong Kong SAR, including through the use of Virtual Private Networks (VPNs), proxies, or any other tools designed to bypass our geographical restrictions.
  • Generate Harmful Content: Prompt, generate, output, distribute, or use the Services to create any harmful content. This includes, but is not limited to, content that is:
    • Illegal, defamatory, obscene, or pornographic (including non-consensual sexual content and child sexual abuse material);
    • Violent, gruesome, or promoting terrorism, self-harm, or eating disorders;
    • Hateful, harassing, or discriminatory against any group or individual based on race, religion, gender, sexual orientation, or other protected characteristics;
    • Invasive of privacy rights (such as doxxing or uploading images of individuals without their consent);
    • Malicious deepfakes, disinformation, or content designed to manipulate public opinion or elections.
  • Bypass Safety Systems: Attempt to jailbreak, bypass, manipulate, or disable any safety filters, content moderation systems, or core AI instructions implemented by Joyfun AI to prevent the output of harmful content.
  • Ladda ner, modifiera, kopiera, distribuera eller skapa härledda verk från vår äganderättsligt skyddade teknik, med undantag för det innehåll du genererar.
  • Use the Services for bullying, fraud, scamming, or in a manner that is deceptive or facilitates any harmful or illegal activities.
  • Dekompilera, bakåtutveckla eller demontera Tjänsterna.
  • Använda robot, spindel eller andra automatiserade medel för att få tillgång till Tjänsterna för något ändamål utan vårt uttryckliga skriftliga tillstånd.
  • Introduce any viruses, malware, or other malicious code into our systems.
  • Use the Services to build a competitive product or service.
  • Represent that content generated by the Services is entirely human-generated. You must clearly disclose that such content was created using artificial intelligence technologies so as not to mislead others.

3. Ditt innehåll och äganderätt

As part of your use of the Services, you may input information (“User Input”) and the Services will generate new content based on your input (“User Output”). Your User Input and User Output are collectively referred to as “Your Content.” As between you and Joyfun AI, you own all rights in Your Content. We do not claim any ownership over it. You are free to use Your Output for any purpose, including commercial purposes, provided it complies entirely with these Terms (especially the restrictions on Harmful Content outlined in Section 2). By using the Services, you grant Joyfun AI a royalty-free, worldwide, transferable, sublicensable, and irrevocable license to access, use, host, store, reproduce, modify, and create derivative works from Your Content for the limited purposes of operating, improving, and providing the Services, and to develop new technologies. This includes using Your Content to train and improve our artificial intelligence models. This license continues even if you stop using our Services. You represent and warrant that you have all necessary rights, licenses, and permissions to submit Your Input and that Your Content will not violate any laws, contain harmful content, or infringe on the rights of any third party. Content Moderation: We reserve the right (but not the obligation) to monitor, review, block, filter, or delete any User Input or User Output that we determine, in our sole discretion, violates these Terms, attempts to bypass our safety filters, or constitutes harmful content. Due to the nature of generative AI, User Output may not be unique, and other users may generate similar content. Your ownership rights apply only to your specific User Output.

4. Giltighetstid och uppsägning

These Terms take effect when you first access the Services and remain in effect until terminated. You may terminate these Terms at any time by simply discontinuing your use of the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, if you violate any provision of these Terms, particularly regarding geographical restrictions eller generation of harmful content. Upon termination, you must cease all use of the Services and any User Output you have generated in violation of these Terms.

5. Ansvarsfriskrivning och ansvarsbegränsning

THE SERVICES ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, SECURE, OR ERROR-FREE. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). You acknowledge that factual assertions in User Outputs may be inaccurate and should be independently verified. We assume no liability for any content (including harmful or offensive content) that you or any third party creates, generates, or is exposed to while using our Services.

6. Skadestånd

You agree to indemnify and hold harmless Joyfun AI, its affiliates, directors, officers, agents, and employees from and against any claims, losses, damages, liabilities, and expenses, including attorneys’ fees, arising out of your breach of these Terms, your violation of applicable law, your bypassing of safety systems, your violation of our harmful content policy, or your use of the Services or User Output.

7. Intellektuell egendom

The Services contain intellectual property owned by Joyfun AI, including our name, logo, algorithms, designs, text, graphics, and the “look and feel.” You are prohibited from using any of our intellectual property without our prior written consent.

8. Klagomål om upphovsrätt

Om du anser att dina immateriella rättigheter har kränkts av en användare av tjänsterna, vänligen skicka ett meddelande till support@joyfun.ai med ämnesraden "Copyright Complaint". Ditt meddelande måste innehålla: en beskrivning av det upphovsrättsskyddade verket, var det material som gör intrång finns, din kontaktinformation, en förklaring om att du är i god tro och en förklaring, under straffansvar för mened, att du är upphovsrättsinnehavaren eller behörig att agera för deras räkning.

9. Tvistlösning

Dessa villkor ska styras av lagarna i delstaten Kalifornien, utan hänsyn till dess principer om lagkonflikt. Alla tvister som uppstår i samband med dessa villkor ska lösas genom slutgiltigt och bindande skiljeförfarande, snarare än i domstol.

10. Meddelande om ändringar

Vi kan komma att ändra dessa villkor från tid till annan och kommer då att uppdatera datumet "Gäller från och med" högst upp. Din fortsatta användning av tjänsterna efter att ändringarna har trätt i kraft kommer att anses vara ditt godkännande av de ändrade villkoren. Om du inte samtycker till ändringarna måste du sluta använda våra tjänster.
