Όροι χρήσης της Joyfun AI

Γενικά

Με την πρόσβαση και τη χρήση του λογισμικού, των εργαλείων, των δεδομένων ή του ιστότοπου της Joyfun AI (συλλογικά, "Υπηρεσίες"), συμφωνείτε ρητά ότι έχετε διαβάσει και συμφωνείτε να δεσμεύεστε από τους ακόλουθους όρους και προϋποθέσεις (οι "Όροι"), καθώς και από όλους τους ισχύοντες νόμους και κανονισμούς. Συμφωνείτε επίσης ότι είστε 18 ετών και άνω και ότι είστε νομικά σε θέση να συνάψετε δεσμευτική σύμβαση. Geographical Restrictions: The Services are strictly prohibited for use by individuals or entities located in, residing in, or accessing the Services from Mainland China and the Hong Kong Special Administrative Region (SAR). By using the Services, you represent and warrant that you are not located in or accessing the Services from these restricted regions. Definitions:

1. Δήλωση απορρήτου

2. License to Use the Services and Usage Restrictions

We grant you a non-exclusive, non-transferable right to access and use the Services in accordance with these Terms. Joyfun AI retains all right, title, and interest in the Services. To ensure a safe and lawful environment, you strictly agree that you may not:
  • Violate Geographical Restrictions: Access, or attempt to access, the Services from Mainland China or Hong Kong SAR, including through the use of Virtual Private Networks (VPNs), proxies, or any other tools designed to bypass our geographical restrictions.
  • Generate Harmful Content: Prompt, generate, output, distribute, or use the Services to create any harmful content. This includes, but is not limited to, content that is:
    • Illegal, defamatory, obscene, or pornographic (including non-consensual sexual content and child sexual abuse material);
    • Violent, gruesome, or promoting terrorism, self-harm, or eating disorders;
    • Hateful, harassing, or discriminatory against any group or individual based on race, religion, gender, sexual orientation, or other protected characteristics;
    • Invasive of privacy rights (such as doxxing or uploading images of individuals without their consent);
    • Malicious deepfakes, disinformation, or content designed to manipulate public opinion or elections.
  • Bypass Safety Systems: Attempt to jailbreak, bypass, manipulate, or disable any safety filters, content moderation systems, or core AI instructions implemented by Joyfun AI to prevent the output of harmful content.
  • Να κατεβάζετε, να τροποποιείτε, να αντιγράφετε, να διανέμετε ή να δημιουργείτε παράγωγα έργα από την ιδιόκτητη τεχνολογία μας, εκτός από το περιεχόμενο που δημιουργείτε εσείς.
  • Use the Services for bullying, fraud, scamming, or in a manner that is deceptive or facilitates any harmful or illegal activities.
  • Αποσυμπίληση, αντίστροφη μηχανική ή αποσυναρμολόγηση των Υπηρεσιών.
  • Να χρησιμοποιήσετε οποιοδήποτε ρομπότ, αράχνη ή άλλο αυτοματοποιημένο μέσο για να αποκτήσετε πρόσβαση στις Υπηρεσίες για οποιονδήποτε σκοπό χωρίς τη ρητή έγγραφη άδειά μας.
  • Introduce any viruses, malware, or other malicious code into our systems.
  • Use the Services to build a competitive product or service.
  • Represent that content generated by the Services is entirely human-generated. You must clearly disclose that such content was created using artificial intelligence technologies so as not to mislead others.

3. Το περιεχόμενό σας και η ιδιοκτησία

As part of your use of the Services, you may input information (“User Input”) and the Services will generate new content based on your input (“User Output”). Your User Input and User Output are collectively referred to as “Your Content.” As between you and Joyfun AI, you own all rights in Your Content. We do not claim any ownership over it. You are free to use Your Output for any purpose, including commercial purposes, provided it complies entirely with these Terms (especially the restrictions on Harmful Content outlined in Section 2). By using the Services, you grant Joyfun AI a royalty-free, worldwide, transferable, sublicensable, and irrevocable license to access, use, host, store, reproduce, modify, and create derivative works from Your Content for the limited purposes of operating, improving, and providing the Services, and to develop new technologies. This includes using Your Content to train and improve our artificial intelligence models. This license continues even if you stop using our Services. You represent and warrant that you have all necessary rights, licenses, and permissions to submit Your Input and that Your Content will not violate any laws, contain harmful content, or infringe on the rights of any third party. Content Moderation: We reserve the right (but not the obligation) to monitor, review, block, filter, or delete any User Input or User Output that we determine, in our sole discretion, violates these Terms, attempts to bypass our safety filters, or constitutes harmful content. Due to the nature of generative AI, User Output may not be unique, and other users may generate similar content. Your ownership rights apply only to your specific User Output.

4. Λήξη και καταγγελία

These Terms take effect when you first access the Services and remain in effect until terminated. You may terminate these Terms at any time by simply discontinuing your use of the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, if you violate any provision of these Terms, particularly regarding geographical restrictions ή το generation of harmful content. Upon termination, you must cease all use of the Services and any User Output you have generated in violation of these Terms.

5. Αποποίηση ευθυνών και περιορισμός ευθύνης

THE SERVICES ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, SECURE, OR ERROR-FREE. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). You acknowledge that factual assertions in User Outputs may be inaccurate and should be independently verified. We assume no liability for any content (including harmful or offensive content) that you or any third party creates, generates, or is exposed to while using our Services.

6. Αποζημίωση

You agree to indemnify and hold harmless Joyfun AI, its affiliates, directors, officers, agents, and employees from and against any claims, losses, damages, liabilities, and expenses, including attorneys’ fees, arising out of your breach of these Terms, your violation of applicable law, your bypassing of safety systems, your violation of our harmful content policy, or your use of the Services or User Output.

7. Πνευματική ιδιοκτησία

The Services contain intellectual property owned by Joyfun AI, including our name, logo, algorithms, designs, text, graphics, and the “look and feel.” You are prohibited from using any of our intellectual property without our prior written consent.

8. Καταγγελίες πνευματικών δικαιωμάτων

Εάν πιστεύετε ότι τα δικαιώματα πνευματικής ιδιοκτησίας σας έχουν παραβιαστεί από κάποιον χρήστη των Υπηρεσιών, στείλτε ειδοποίηση στη διεύθυνση support@joyfun.ai με θέμα "Καταγγελία για πνευματικά δικαιώματα". Η ειδοποίησή σας πρέπει να περιλαμβάνει: μια περιγραφή του έργου που προστατεύεται από πνευματικά δικαιώματα, τον τόπο όπου βρίσκεται το υλικό που παραβιάζει τα δικαιώματα, τα στοιχεία επικοινωνίας σας, μια δήλωση καλής πίστης και μια δήλωση, επί ποινή ψευδορκίας, ότι είστε ο κάτοχος των πνευματικών δικαιωμάτων ή εξουσιοδοτημένος να ενεργείτε εκ μέρους του.

9. Επίλυση διαφορών

Οι παρόντες Όροι διέπονται από τους νόμους της Πολιτείας της Καλιφόρνια, χωρίς να λαμβάνονται υπόψη οι αρχές σύγκρουσης νόμων. Κάθε διαφορά που προκύπτει από τους παρόντες Όρους θα επιλύεται μέσω οριστικής και δεσμευτικής διαιτησίας και όχι ενώπιον δικαστηρίου.

10. Κοινοποίηση αλλαγών

Ενδέχεται να τροποποιούμε τους παρόντες Όρους από καιρό σε καιρό και θα ενημερώνουμε την ημερομηνία "Ισχύει από" στην κορυφή. Η συνέχιση της χρήσης των Υπηρεσιών από εσάς μετά την έναρξη ισχύος των τροποποιήσεων θα θεωρείται ότι αποδέχεστε τους τροποποιημένους Όρους. Εάν δεν συμφωνείτε με τις αλλαγές, πρέπει να σταματήσετε να χρησιμοποιείτε τις Υπηρεσίες μας.
